TERMS OF SERVICE

4.2.1 Your Ownership

You retain all ownership rights in your User Content, subject to the licenses granted herein.

4.2.2 License to VUBO Inc.

You grant VUBO Inc. a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with:

• Operating, providing, improving, and promoting the Service
• Developing new products and services
• Internal research and development purposes
• Marketing and promotional activities
• For any other lawful business purposes

4.2.3 License Duration

The licenses granted in this section remain in effect even if you stop using the Service, except that you may revoke licenses to specific User Content by deleting such content from the Service, if such deletion option is available.

4.3.1 Prohibited Content

Upload, generate, or share content that:

• Is illegal, harmful, abusive, defamatory, obscene, pornographic, hateful, invasive of privacy, discriminatory, or otherwise objectionable
• Promotes violence, terrorism, self-harm, or illegal activities
• Infringes or violates any intellectual property rights or other rights of any party
• Contains nudity or sexually explicit material
• Constitutes unauthorized advertising, spam, or solicitation
• Is misleading, deceptive, or impersonates any person or entity
• Contains viruses, malware, or other harmful code
• Attempts to manipulate, deceive, or defraud users or systems
• Creates deepfakes or synthetic media of individuals without their express consent
• Creates synthetic political content that could influence elections, voting, or democratic processes
• Creates, distributes, or promotes deliberately misleading news content or misinformation
• Attempts to bypass our content filters or moderation systems

4.3.2 Prohibited Conduct

• Engage in any activity that interferes with or disrupts the Service
• Attempt to gain unauthorized access to the Service or related systems
• Use automated tools, bots, scraping, or data mining techniques without written permission
• Reverse engineer, decompile, or disassemble any portion of the Service
• Remove any copyright, trademark, or proprietary notices
• Use the Service to develop competing products or services
• Exceed usage limits or engage in excessive or abusive usage patterns
• Circumvent any technological measures implemented to restrict access
• Violate any third-party terms or conditions when using the Service

4.4.1 DMCA Compliance

VUBO Inc. complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been used on the Service in a way that constitutes copyright infringement, please submit a detailed notification to legal@vubo.ai including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

4.5.1 No Guarantees and AI Liability Shield

You acknowledge and agree that AI-generated content is inherently unpredictable and may be inaccurate, incomplete, offensive, biased, or inappropriate. VUBO Inc. makes no representations or warranties regarding the quality, accuracy, reliability, appropriateness, or non-infringing nature of such content. You expressly acknowledge that, despite VUBO Inc.'s reasonable efforts to implement safety measures and content filters, the fundamental nature of generative AI technology is such that unexpected, unintended, or potentially harmful outputs may occur. VUBO Inc. expressly disclaims all liability for any such outputs.

4.5.2 User Responsibility

You are solely responsible for reviewing, evaluating, and moderating all AI-generated content before using, publishing, or sharing it. You assume all risks associated with using, modifying, distributing, or otherwise exploiting AI-generated content, including but not limited to legal risks, reputational risks, and any potential harm to third parties.

4.5.3 AI Training Rights

You hereby grant VUBO Inc. the right to use, reproduce, modify, and analyze any User Content you upload or generate through the Service for the purpose of training, improving, or developing AI models, algorithms, and related technologies. This grant includes the right to create derivative works based on your User Content for these purposes. VUBO Inc. agrees to use reasonable efforts to anonymize personal information when using User Content for AI training purposes.

4.5.4 Third-Party API Processing

You acknowledge and agree that VUBO Inc. may transmit your User Content to third-party API providers who may process, analyze, or use such content in accordance with their own terms of service and privacy policies, which may include using your content for training their own AI models. By using the Service, you expressly consent to such transmission and potential use of your content by these third-party providers. VUBO Inc. has no control over, and assumes no responsibility for, the privacy practices or content usage policies of these third-party providers.

4.6.1 Monitoring and Removal

VUBO Inc. employs automated and human moderation systems to detect violations of these Terms but cannot guarantee the immediate removal of all inappropriate content. We reserve the right to monitor, review, and remove any User Content at our sole discretion, without prior notice.

4.6.2 Reporting Violations

Users can report potentially violating content by contacting legal@vubo.ai.

4.6.3 Right to Investigate

VUBO Inc. may investigate suspected violations of these Terms and take appropriate actions, including but not limited to issuing warnings, removing content, suspending or terminating accounts, and reporting illegal activities to law enforcement.

4.7.1 Shareable Links

The Service may allow you to generate public links to your content. You are responsible for controlling the distribution of these links and for all content shared via such links.

4.7.2 No Liability for Shared Content

VUBO Inc. is not liable for any consequences arising from content you share publicly, including but not limited to reputational damage, legal claims, or misuse by third parties.

4.8.1 Fair Use Content

You acknowledge that the Service may inadvertently feature User Content or third-party templates potentially qualifying as fair use under copyright law. VUBO Inc. aims to prevent copyright infringement but cannot guarantee that all Content on the Service is free from intellectual property claims.

4.8.2 Copyright Infringement

VUBO Inc. respects intellectual property rights and expects users to do the same. We will promptly address legitimate infringement notices received at legal@vubo.ai in accordance with our Copyright Policy.

4.8.3 Celebrity Likeness and Public Figures

You acknowledge and agree that:

• VUBO Inc. is not responsible for User Content that references, depicts, or otherwise incorporates the likeness, name, voice, or identity of any public figure, celebrity, or other individual
• VUBO Inc. functions as a neutral platform provider that offers general-purpose video editing and generation tools, similar to other editing platforms and software
• You are solely responsible for obtaining any necessary permissions, releases, or licenses for incorporating any individual's likeness, name, voice, or identity into your User Content
• You will indemnify and hold harmless VUBO Inc. from any claims, damages, or liabilities arising from your use of any individual's likeness, name, voice, or identity in User Content created through the Service
• You acknowledge that VUBO Inc. does not monitor or pre-approve prompts or templates related to specific individuals and has no obligation to do so
